JUDGMENT / ORDER

Court No. - 50
Case :- CONTEMPT APPLICATION (CIVIL) No. - 3604 of 2011 Applicant :- Krishna Chandra Mishra And Another Opposite Party :- B.M. Meena Secry. Panchayati Raj Counsel for Applicant :- B.S. Pandey Counsel for Opposite Party :- S.C.
Hon'ble Jayant Banerji,J.
Heard Shri B.S. Pandey, learned counsel for the applicants.
This application has been filed alleging disobedience of the judgement and order dated 15.7.2010 passed in Special Appeal Defective No.- 647 of 2010 (State of U.P. Secretary Panchayat Raj, U.P. Govt. Vs. Pradeep Kumar Tripathi and others), whereby the judgement and order dated 23.3.2010 passed by the writ Court in Writ Petition No. 55622 of 2009 (Pradeep Kumar Tripathi and another Vs. State of U.P. and others) was modified to the extent that the amount deposited by the Principal Secretary was directed to be refunded to him but the State was directed to deposit the amount before the Registrar General of this Court and was to be paid to the respondents within four weeks.
It is the contention of the learned counsel for the applicant that the State has not deposited the amount.
This is a matter of enforcement of the order of the Court relating to payment of cost and for recovery of which, the procedure prescribed under Rule 11 of Chapter XXII of the Allahabad High Court Rules may be resorted to.
This contempt application is, accordingly, dismissed.
Order Date :- 26.4.2019 A. V. Singh (Jayant Banerji, J.)
