The petitioner is aggrieved by an order dated 3.10.2018 passed by the sixth respondent, Secretary of Banguwan Kala Sadhan Sahkari Samiti Limited, Talbehat, District Lalitpur.
Shri Siddharth Singh, learned Additional Chief Standing Counsel has raised preliminary objection that the writ petition, as has been framed and drawn, cannot be maintained as no relief can be accorded to the petitioner.
Once the objection has been raised then the Court has proceeded to examine the record in question and finds that admittedly, the fair price shop in question is being run and managed by the Society in question. By the order dated 16.2.2018 passed by the Assistant Registrar (Cooperative), Lalitpur, the petitioner was appointed as Supervisor of the fair price shop in question and as an internal arrangement, the petitioner was running the fair price shop in question. By the impugned order dated 3.10.2018, the communication has been made by the Secretary of the Society to the Sub Divisional Magistrate, Tehsil Talvehat, District Lalitpur wherein he has requested that the petitioner may not be issued any essential commodities. Once the Society in question itself has taken a decision as an internal arrangement then in such situation no relief can be extended to the petitioner.
The writ petition sans merit and is accordingly dismissed.
However, dismissal of the writ petition would not come in the way of the petitioner to agitate his grievance before the appropriate forum.
