Heard learned counsel for the applicants and learned A.G.A. for the State.
This anticipatory bail application has been filed on behalf of the applicants seeking anticipatory bail in Case Crime No. 292 of 2020, under Sections - 392, 302 I.P.C., Police Station - Auraiya, District - Auraiya, during the pendency of trial.
This anticipatory bail application is not maintainable, for the reason that the sections involved are Sections - 392 and 302 I.P.C. and one of the offences is punishable inter-alia by death sentence also, therefore the remedy cannot be granted, as such.
Also heard the learned A.G.A.
In case, the applicants have any grievance, they may avail remedy before the appropriate forum. No good ground is made out for anticipatory bail.
Consequently, the instant anticipatory bail application is
dismissed, at this stage.
It is made clear that observation made in this order shall have no bearing on the merits of the case.
