Heard the learned counsel for the appellant, leaned A.G.A. for the State of U.P. and perused the lower court record.
This is second bail application moved by the appellant Krishan Pal alias Lala, his first bail application has been refused by another bench of this court on 21.10.2011, the ground taken in the second bail application touching the merits of the case have already been considered at the time of disposal of the first bail application. The order dated 21.10.2011 shows that the appellant Krishan Pal is a previous convict also. He has been convicted under section 302 I.P.C. against which he had filed the criminal appeal no. 4192 of 2010. There is no good ground to release the appellant on bail. The prayer for bail is refused.
Accordingly the bail application is rejected.
