Learned counsel for the petitioners is permitted to implead Additional Secretary, Secondary Education Board, Regional Office, Meerut as respondent no. 4 in the array of respondents during course of the day.
Heard learned counsel for the petitioners and learned Standing Counsel appearing for the respondents.
Learned counsel for the petitioners has submitted that an exparte recommendation dated 8.4.2019 was made for withdrawal of recognition given to the petitioners' institution namely Tapsthali Vidhyapeeth Inter College, Unchagaon, Mathura. He further submitted that by perusal of the recommendation dated 8.4.2019, it is apparently clear that the recommendation has been made only after hearing the complainant, therefore, the impugned order is bad and liable to be set aside.
Learned Standing Counsel has submitted that the petitioner may file his objection before the respondent no. 4- Additional Secretary, Secondary Education Board, Regional Office, Meerut that while taking decision on the recommendation dated 8.4.2019 he may considering his reply.
Considering the facts and circumstances of the case, this petition is disposed of with liberty to the petitioner to file his objection before the respondent no. 4- Additional Secretary, Secondary Education Board, Regional Office, Meerut within one week from today and in case any such objection is filed by the petitioner before the respondent no. 4, he shall consider the same while taking decision on the recommendation dated 8.4.2019 made by respondent no. 2.
It is made clear that the Court has not adjudicated the matter on merits. It is upon the respondent no. 4 to decide the objection after considering the facts of the case as well as rules occupying the field.
