In compliance of the order dated 26.11.2018 the Registrar, Allahabad State University, Allahabad is present before the Court. An affidavit duly sworn by Prbhash Dwivedi, Deputy Registrar, Allahabad State University, Allahabad is also filed.
The contents of para-3 of the aforesaid affidavit filed by the Deputy Registrar are quoted herein below:-
"3. That the unfair means committee has considered the case of the petitioner and exonerated him from using unfair means now the copy has granted to the examiner for checking of which the results are likely to come very soon."
Learned counsel for the petitioner has submitted that the University has closed the admission in 5th Semester and the last date for said closure was 20th October, 2018.
Learned counsel for the petitioner therefore has submitted that unless and until the University will open the Login ID, the petitioner cannot be allowed in 5th Semester Course.
The Registrar Sri S.N. Pandey is present and has submitted before the Court that immediately after declaration of the petitioner's result he will open the Login and permit the petitioner to continue as regular student in 5th Semester Course.
In the aforesaid background the Court appreciate the action of the Registrar and expect that the aforesaid process be completed by the respondent University within two weeks.
As pointed out by the Registrar, Allahabad State University, Allahabad, the said exercise has to be carried out by the respondent no. 3, Examination Controller, Allahabad State University Allahabad within a period, as indicated herein above i.e. within two weeks.
The writ petition is disposed of accordingly.
