Heard learned counsel for the applicants.
This petition alleges violation of an interim order passed by the writ Court on 17 May 2012. The interim order reads thus:
"Till the next date of listing, the parties to the suit shall maintain status quo. However, if any construction is being made, the same will be raised at the own risk of the parties."
Presently and on the state of the record as it exists today, this Court finds no material which may indicate whether this order was extended beyond 17 May 2012, since admittedly the same was to operate only till the next date of listing. Even otherwise the alleged constructions which are stated to be in the process of being raised would not fall foul of the interim order since it was clearly provided that any construction that may be made would be at the risk of parties themselves. There was thus no injunction against raising of constructions.
The contempt petition is misconceived and is dismissed as such.
