Submission of petitioner's Counsel is that the petitioner's claim for compassionate appointment has been rejected under the garb of the Circular dated 15.2.1993 of the U.P.Education Board, on the ground that the petitioner does not possess qualification of BTC/Special BTC. Learned Counsel for the petitioner submits that the aforesaid circular is contrary to the provisions of Clause 3(4) of the G.O. dated 4.9.2000 which provides that the dependent of deceased died in harness be given appointment on the post of Assistant Teacher, if she/he possess requisite qualification except the training qualification and such person shall be imparted training after his/her appointment.
Learned Standing Counsel is directed to seek instructions as to whether G.O. dated 4.9.2000 is still in existence and if it is so then under what circumstances the Board has issued circular contrary to the Government Order.
