Sri Dileep Kumar Yadav, has filed Vakalatnama on behalf of opposite party no. 2, which is taken on record.
Heard Sri Birendra Singh, counsel for the revisionist, counsel for opposite party no. 2 and learned AGA.
Present revision has been filed against the judgement and order dated 15.2.2018 passed by Additional Session Judge, Court no. 2, Allahabad in S.T. No. 901 of 2015 (State vs. Budul Yadav) u/s 302/34 IPC, P.S. Meja, District Allahabad whereby the revisionist has been summoned the face trial u/s 319 Cr.P.C,.
I have perused the impugned order and found that the trial court has taken into account the evidence of two prosecution witnesses and there appears strong and cogent evidence against the revisionist for summoning him for the offence u/s 302 IPC. There is no illegality or impropriety in the impugned order.
Learned counsel has drawn attention of the court towards the contradiction between the statement of PW-1 and PW-2. In my opinion the said contradiction could not be looked into and appreciated at this stage. I do not find any ground to interfere in the order.
Accordingly, the revision lacks merit and is dismissed Order Date :- 23.3.2018 Dhirendra/
