JUDGMENT / ORDER

Heard the learned senior counsel for the petitioners and the learned Standing Counsel for the respondent Board, apart from perusing the record. Since the issue lies in a narrow compass, this Court proposes to dispose of the writ petition at the admission stage itself. 2. Briefly stated, though the petitioners were said to have been included in the ranked list by the Public Service Commission way back in 2001, initially they had not been engaged by the respondent Corporation as Conductors. Instead, when the respondent Corporation resorted to engage outsiders, the petitioners and similarly placed persons have approached this Court, it was directed that the respondent Corporation should engage them even on temporary basis. Under those circumstances, the petitioners were engaged as Conductors beginning from 2004. Through Exhibit P1 order dated 22.12.2011, the services of the petitioners have also been regularised. When the petitioners came to know that the respondent Corporation would not be reckoning their services from 2004 to 2011, till they were actually regularised, they made Exhibit P2 representation before the authorities concerned to consider their past service for all service benefits including increment as well as the terminal benefits. The grievance of the petitioners is that so far the said representation has not been disposed of.

In the above factual background, the learned senior counsel for the petitioners submitted that the issue has been fairly answered through Exhibit P3 judgment rendered by this Court on an earlier occasion. Accordingly, he urges this Court to dispose of the present writ petition with a direction to the second respondent to consider Exhibit P2 representation in terms of Exhibit P3 judgment of this Court.
4. The learned Standing Counsel, on her part, has fairly submitted that the second respondent would make every endeavour to consider and dispose of Exhibit P2 at the earliest possible.
Having regard to the respective submissions of the learned senior counsel for the petitioners and the respondent Corporation, without expressing any opinion on the merits of the matter, this Court disposes of the present writ petition with a direction to the second respondent to consider Exhibit P2 representation, duly taking into account Exhibit P3 judgment of this Court, and pass appropriate orders thereon as expeditiously as possible, at any rate, within a period of one month from the date of receipt of a copy of this judgment.
