JUDGMENT / ORDER

The petitioner entered service in the Kerala Backward Classes Development Corporation in the year 1999. He was promoted to the category of Junior Project Assistant by order passed on 24.2.2006. This writ petition is filed contending that though as per Ext.P1 special rules the petitioner is eligible to be promoted to the category of Project Assistant, he has not so far been promoted to the said post. It is also stated that pointing out the above fact, the petitioner has moved the Managing Director of the Kerala Backward Classes Development Corporation by submitting Ext.P2 representation requesting him to place it for consideration before the Board of Directors. In this writ petition, the petitioner inter alia seeks a direction to the respondent Corporation to consider Ext.P2 representation and pass appropriate orders thereon within a time limit to be fixed by this Court. 2. When the writ petition came up for hearing today, Sri.V.Jayapradeep, learned standing counsel appearing for the respondent Corporation submitted that if the original of Ext.P2 representation has been received by the Managing Director of the Corporation and it is pending, he will consider the same and pass W.P.(C) No.13375/14 2 appropriate orders thereon, if he is competent to pass orders in the matter or place it for consideration before the Board of Directors at the earliest. In the light of the said submission, I dispose of the writ petition with a direction to the Managing Director of the Kerala Backward Classes Development Corporation to consider the request made by the petitioner in Ext.P2 representation, if the original thereof has been received and is pending, expeditiously and in any event within an outer limit of one month from the date on which the petitioner produces a copy of this judgment along with a copy of the writ petition complete in all aspects before him, if as per the rules, he is empowered and competent to consider the request made by the petitioner in Ext.P2. If the Managing Director is of the opinion that the request made by the petitioner can be considered only by the Board of Directors, the Managing Director shall place Ext.P2 representation for consideration before the Board of Directors of the respondent Corporation and the Board of Directors shall in that event, take an appropriate decision on the petitioner's request within three months from the date on which the Managing Director places the representation before the Board of Directors.
