JUDGMENT / ORDER

The order under challenge in this writ petition is to quash the Circular issued by the first respondent in proceedings dated 26.5.2005.
2. The writ petitioner is a member of the third respondent-Co-operative Bank. In his capacity as a member, he has challenged the Circular issued by the first respondent in relation to the acceptance of fixed deposits from the members.
3. The learned Special Government Pleader, appearing on behalf of the respondents 1 and 2, as well as the learned counsel appearing for the third respondent, made a submission that subsequently, the Schemes and Policies are modified/changed and the Circular issued on 26.5.2005, cannot be now adjudicated in this writ petition in view of the fact that the Co-operative Societies are now permitted to receive fixed deposits from its members and so also to lend money to the members of the Co-operative Societies. Such being the factum of the case, no further adjudication on merits on the grounds raised in this writ petition is to be considered.
4. Accordingly, the writ petition stands dismissed. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is also dismissed.
