JUDGMENT / ORDER

The Writ Petition has been filed seeking a Writ of Mandamus directing the respondents to provide a suitable job to the 2nd petitioner on compassionate ground in any Government Department.
2. Heard the learned counsel for the petitioner, learned Government Advocate for the respondents and perused the documents available on record.
3. Admittedly, 2nd petitioner's father, namely, R.Kumar, while serving as Village Administrative Officer in Iveli and Elayandipatti Villages, suddenly died on 29.03.1998, leaving behind his wife and son, petitioners 1 and 2 respectively and another son. At the time of death of R.Kumar, his son, 2nd petitioner, was only 10 years old and his brother was 11 years old respectively. The wife of the deceased, 1st petitioner submitted a representation on 12.04.1999 to the respondents seeking to provide any suitable job. Thereafter, again, another representation was given by the 1st petitioner in the next year, namely on 10.04.2000 seeking a suitable job to her, as per her qualification. Once again, on 17.09.2001, the 1st petitioner gave another petition seeking job to her first son, namely, Balaji. However, none of her sons were qualified either educationally or age wise to take up any Government job. At this stage, another representation dated 30.12.2005 has been submitted by the 1st petitioner seeking compassionate appointment to her younger son, namely, 2nd petitioner. In the said process, after death of R.Kumar, now, 20 years have gone by.

When the compassionate appointment to any one of the legal heirs itself is evolved to take over the grieved family immediately, on account of sudden demise of bread winner, in the present case, the bread winner of the family, namely, R.Kumar passed away on 23.12.1998, now, after 20 years, the petitioners cannot seek appointment on compassionate ground, hence this Court is unable to entertain the Writ petition and the same stands dismissed. No costs.
