JUDGMENT / ORDER

Petitioner had submitted an application for survey of his property on the basis of his title deed. Admittedly, the property is water logged. By Ext.P7, the Additional Tahsildar attached to the second respondent's office had intimated to the petitioner that since the land involved is in a water logged area, it will be difficult to take the measurements, and that the petitioner was unable to identify the property. 2. According to the petitioner, as per Rule 7(2) of the Kerala Surveys and Boundaries Rule, 1964, if the property is lying in water logged area, still measurements are to be conducted, after putting up coconut stems underneath water. If such steps are to be taken, apparently, two things have to be done; one is the that petitioner will have to identify the property involved, and, secondly, the petitioner will have to make all arrangements and incur all the expenditure involved in carrying out the survey. Under these circumstances, this writ petition is W.P.C.No.14258 OF 2014 2 disposed of as under.
On the Petitioner identifying the property and on making all necessary arrangements at his expense for conducting measurement, the second respondent shall make necessary arrangements to survey the property and appropriate proceeding shall be completed within a period of three months from the date of receipt of a copy of this judgment.
