The second petitioner for himself and on behalf of the first petitioner has filed an affidavit before this Court today (i.e) 27.10.2009, inter alia stating that " they hereby unconditionally undertake to vacate the petition premises on or before 07th November, 2009 and hand over vacant possession to the respondents/landlords and they also acknowledge that they have received a sum of Rs.35,000/- being the advance amount lying in the hands of the respondents/landlords and a further sum of Rs.10,000/- being the amount received by the second respondent in addition to the advance which has been paid to them on 26.10.2009 by cash and further that there are no dues or mutual claims between the parties and there will be no further Civil or Criminal disputes between themselves and the respondents/landlords and also that the respondents/landlords shall withdraw the R.C.O.P.No.2179 of 2007 on the file of the X Small Causes court, Chennai filed for fixation of Fair Rent on handing over the possession of petition premises."

The said affidavit of undertaking filed by the petitioners/tenants is hereby recorded and as per the undertaking, the petitioners / tenants are directed to vacate the petition premises on or before 07.11.2009 and hand over the key to the respondents/landlords and immediately after vacating the petition premises, they are directed to file an affidavit before this Court to that effect.
3. With the above observations, the Civil Revision petition is disposed of. The affidavit filed by the petitioners/tenants shall form part of this order. Connected miscellaneous petition is closed. No costs.
