JUDGMENT / ORDER

The petitioner is the accused in L.P.No.34 of 2007 of the Court of the Judicial First Class Magistrate, Parappanangadi pursuant to Crime No.160 of 2004 of Thirurangadi Police Station. The case registered against the petitioner alleges commission of offences punishable under Section 420 of the IPC. The petitioner states that he was not aware of the pendency of the case and at any rate, he was never arrested and that it is only recently and that he was informed that proceedings are under way for arresting him. Under these circumstances, the petitioner prays that he may be permitted to surrender before the Judicial First Class Magistrate, Parappanangadi on 15.5.2014 and apply for regular bail before that court.
In the facts and circumstances of with the case, I feel that the Crll.M.C itself can be disposed of with the following directions.
1. The petitioner shall surrender before the Judicial First Class Magistrate, Parappanangadi on Crl.M.C.No.2460 of 2014 2 15.5.2014.
2. On the same date the petitioner can file an application for recall of the non-bailable warrant issued against him as also an application for regular bail.
3. If the petitioner files the application aforementioned the Magistrate shall consider the applications on the same day that is 15.5.2014 itself and pass appropriate orders thereon.
4. The execution of the non-bailable warrant now issued against the petitioner shall stand stayed till 15.5.2014.
