K.P.Kavinilavu vs R.Venkatesan

Madras High Court|31 January, 2017

JUDGMENT / ORDER

The revision is filed by the wife in a matrimonial dispute who has filed a petition for dissolution of marriage. The trial has commenced on 10.12.2014 and the petitioner was examined in chief. Thereafter, it has been posted for cross-examination of P.W.1 from January 2015. Till today, the cross-examination of P.W.1 has not yet been completed, though once it was closed and reopened at the instance of the respondent-husband. Hence, the revision has been filed by the wife seeking a direction to the Family Court, Salem to dispose of F.C.O.P.No.485 of 2013 within a fixed time frame. Considering the docket orders that have been filed along with the revision, the learned Judge seems to have allowed the cross-examination of P.W.1 for more than two years, which is a sheer waste of time and he ought not to have done so, especially in a family dispute. Hence, this Court is inclined to direct the learned trial Judge to dispose of the said F.C.O.P. Accordingly, the learned Judge, Family Court, Salem is directed to dispose of F.C.O.P.No.485 of 2013 before 30.04.2017. With this direction, the Civil Revision Petition is disposed of. No costs.
