JUDGMENT / ORDER

Petitioner is the first accused in Crime No. 428/2014 of Kathirur Police Station which has been registered for the offences under Section 323, 406 and 498 A I.P.C. Petitioner is the husband of the de facto-complainant. They have been married for the last three years.
2. The allegation against him is that demanding more dowry, he subjected her to cruelty both physical and mental. There is also an allegation that he has mis-appropriated the amount and ornaments of the de facto-complainant.
3. Heard both sides.
4. It is submitted by the learned counsel for the petitioner that the allegations are false and the petitioner is innocent. There are no serious allegations against the petitioner or having committed any violence towards the de facto-complainant. The attempt of the Court should be to help the parties to reach a

reconciliation. In this view, I am inclined to grant the prayer of the petitioner.
In the result, this Bail Application is allowed.
1. The petitioner shall be released on bail on his executing a bond for Rs. 25,000/- with two solvent sureties each for the like sum if he is arrested by the Police in connection with this case.
2. They shall appear before the Investigating Officer for interrogation if he is for required by him in writing.
3. He shall not destroy or tamper with evidence.
4. He shall not harass the defacto-complainant or her relatives.
5. This order is not applicable if the petitioner choose surrender before the Magistrate concerned and in such case the learned Magistrate may take appropriate action in accordance with the law.
