ORDER:
This Writ Petition is filed for a Mandamus to declare the action of respondent No.2, in not passing order on the stay application filed by the petitioner against proceedings in Rc.J/934/2014, dated 05.08.2014, of respondent No.3, whereby he has kept the petitioner’s fair price shop authorisation under suspension, as illegal and arbitrary.
The petitioner’s fair price shop authorisation was suspended by respondent No.3 by the above-mentioned order. Feeling aggrieved thereby, the petitioner filed an appeal before respondent No.2. Along with the appeal, he has filed an application for stay. As the stay application is not disposed of by respondent No.2, the petitioner filed the present Writ Petition.
After hearing the learned counsel for both parties, I am of the opinion that as the appeal itself arises out an order of suspension, it would be in the interests of justice that respondent No.3 completes the enquiry and passes a final order.
Accordingly, respondent No.3 is directed to complete the enquiry and pass a final order within a period of two months from the date of receipt of a copy of this order.
Subject to the above direction, the Writ Petition is disposed of.
As a sequel to disposal of the Writ Petition, W.P.M.P.No.38459 of 2014 filed by the petitioner for interim relief is disposed of as infructuous.
