This Writ Petition is filed under Articles 226 and 227 of the Constitution of India, praying to call for the entire records pertaining to the case of the petitioner, quash the impugned order dtd.12.7.2016, issued by the R-3 wherein recognized/accepted the constitution of new committee constituted in violation of order dtd.24.2.2016 passed by the R-2 vide Annex-E as is illegal, Arbitrary, Capricious and passed without application of mind and etc.
This Petition coming on for Preliminary Hearing in ‘B’ this day, the Court made the following:-
ORDER None for the petitioner.
Sri.V.Shivareddy, learned High Court Government Pleader for the respondent Nos.1 to 3.
2. In this petition, the petitioner inter alia has prayed for the following reliefs:
“1) To quash, the impugned order bearing No.S.O.C:491/2002-03, dated 12.07.2016, issued by the Third Respondent wherein recognized/accepted the constitution of new Committee constituted in violation of Order dated 24.02.2016 passed by the Second Respondent which is produced and marked as Annexure-E as is illegal, arbitrary, capricious and passed without application of mind.
2) To, issue a writ of mandamus, in the nature or order or direction directing the Third Respondent to constitute/form a new Committee in accordance with the directions issued by the Second Respondent on 24.02.2016, in the interest of justice and equity.
3) To, grant, any such other relief or reliefs as this Hon’ble Court deems fit to grant under the circumstance of the case, in the interest of justice and equity.”
3. When the matter was taken up today, learned High Court Government Pleader submitted that the term of the newly constituted Committee shall expire on 23.02.2019. Therefore, nothing survives for adjudication in this writ petition at this point of time.
Accordingly, the petition is disposed of.
