Kottaisamy vs Muthuramalingam

Madras High Court|19 January, 2017

JUDGMENT / ORDER

Today, when the matter is taken up for hearing, the learned Counsel for the petitioner submits that the petitioner is dead. He further submits that despite he made a communication to the legal heirs of the deceased asking them to take further steps to go ahead with the matter, there was no response from them. Hence, he prays for appropriate orders.
2. It is seen from the docket order that the petitioner made such submission on 22.11.2016 itself stating that the petitioner died and time was granted to the petitioner to bring on legal heirs of the deceased. However, in the light of the afore-said submission, the Civil Revision Petition is dismissed as 'abated'. No costs. Consequently, connected miscellaneous petition is closed.
To (1)The Sub-Court, Sivagangai.
(2)The Record Keeper, V.R.Section, Madurai Bench of Madras High Court, Madurai.
