ORDER: (per the Hon’ble The Chief Justice Sri Kalyan Jyoti Sengupta)
This Writ Petition has been filed alleging inaction on the part of respondents 1 to 3 pertaining to the complaint made by the petitioners against unauthorized construction of a structure at Grama Kantam land of Gadi Area of Old Tandur, Tandur Village and Mandal, Ranga Reddy District.
In the counter-affidavit filed by the second respondent, it is stated that action has already been taken and the persons concerned were asked to stop construction of the structure.
Learned counsel for the petitioners submits that in disobedience of the above order, construction of the structure is complete.
We are of the view that when action has been taken by the municipal authority, the matter should not be kept pending. We direct the municipal authority to take complete action pursuant to the complaint made. In the process, unofficial respondents should be heard, if they are required to be heard.
The Writ Petition is closed in terms of the above order. The entire exercise is to be completed, if it is required to be done, within a period of six weeks from the date of communication of this order. No order as to costs.
Consequently, pending miscellaneous petitions, if any, shall stand dismissed.
