HONOURABLE SRI JUSTICE S.RAVI KUMAR TRANSFER C.M.P.No.389 of 2013 ORDER:
This petition is filed to withdraw H.M.O.P.No.24 of 2013 from Senior Civil Judge, Chirala, Prakasam District and transfer the same to Senior Civil Judge, Guntur for disposal in accordance with law.
Petitioner is the wife and according to her, she gave a complaint to police against respondent herein and police registered the same as a crime No.361 of 2012 and investigating the case and that she has a life threat at Chirala and for these two reasons and also for her inconvenience, she sought transfer of O.P. filed by her husband from Senior Civil Judge, Chirala to Senior Civil Judge, Guntur.
Respondent in spite of serving notice neither appeared in person nor through any advocate.
Heard arguments.
Considering the reasons stated in the affidavit and also considering the convenience of the wife, I feel that her request for transfer can be considered. Though petitioner sought transfer of O.P. to Senior Civil Judge, Guntur, since there is Family Court for trial of family disputes, this has to be transferred to that court.
For these reasons, H.M.O.P.No.24 of 2013 is withdrawn from the file of Senior Civil Judge Chirala, Prakasam District and transferred to the Family Court, Guntur for disposal according to law.
As a sequel to the disposal of this Transfer C.M.P., the Miscellaneous Petitions, if any, pending, shall stand dismissed.
