JUDGMENT / ORDER

HON’BLE SRI JUSTICE CHALLA KODANDA RAM W.P.No. 8593 of 2004 DATE: 28.04.2014 Between:
Kosaraju Veeraiah Chowdary and two others .. Petitioners And The Joint Collector & Additional District Magistrate and another .. Respondents O R D E R:-
This writ petition is filed seeking to quash the proceedings dated 02.07.2003 issued by the 1st respondent – Joint Collector & Additional District Magistrate whereby the title deeds / pattadar passbooks issued in favour of the petitioners in respect of the entire extent of Ac.4.02 cents of wet land in Sy.No.801 situated in Nidubrolu village, Ponnuru Mandal, Guntur District, were cancelled.
The learned counsel for both the parties have submitted that during pendency of the writ petition, a partition suit in O.S.No.98 of 2001 on the file of the Court of the Senior Civil Judge, Bapatla was disposed of on 07.12.2009 determining the respective rights of the parties i.e. the petitioners on the one hand and the 2nd respondent on the other and the judgment in that suit has been accepted by both the parties.
In the light of the fair submission made by the learned counsel for both the parties, this Court is inclined to dispose of the writ petition with the following direction:
“The 1st respondent – Joint Collector & Additional District Magistrate, Guntur District is directed to consider the cases of the petitioners for issuance of respective pattadar pass books and title deeds in terms of the judgment and decree dated 07.12.2009 passed in O.S.No.98 of 2001 on the file of the Court of the Senior Civil Judge, Bapatla. It is left open to the parties to approach the revenue authorities for appropriate orders in their favour.”
With the above direction, the writ petition is disposed of. No order as to costs.
As a sequel to the disposal of the writ petition, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
