ORDER:
This writ petition is filed with the grievance that though the petitioner’s fair price shop authorization is subsisting, she is discontinued as fair price shop dealer and certain third parties are being entrusted with the distribution of essential commodities.
As this Court prima facie found that the action of respondents 2 and 3 is not legal and proper, it has directed both the respondents to be personally present. Today, at the hearing, the incumbents of respondents 2 and 3 are personally present and they conceded that they have committed an illegality in discontinuing the petitioner only on the basis of initiation of proceedings under Section 6-A of the Essential Commodities Act, 1955. Respondent No.2 has assured that he will immediately take appropriate steps for continuing the petitioner as fair price shop dealer, by restoring supplies to her, so long as her authorization remains in force.
In view of the above assurance given by respondent No.2, the writ petition is disposed of with a caution to respondents 2 and 3 not to repeat such conduct in future.
As a sequel to the disposal of the writ petition, W.P.M.P.No.42317 of 2014 shall stand disposed of as infructuous.
