HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.32329 of 2014 ORDER:
The petitioner claims that the vendor of the petitioner purchased house site to an extent of 203.57 square yards in Ward No.10, Survey No.361 of Bobbili Municipality, Vizianagaram District, by way of a registered Sale Deed, dated 23.09.1998. When the vendor of the petitioner approached the Sub-Registrar, Bobbili, Vizianagaram District (2nd respondent) to ascertain the market value and the stamp duty payable, the Sub-Registrar refused to furnish the information holding that the property is classified as Gramakantam. Aggrieved thereby, this writ petition is instituted.
2. No material is enclosed to the writ affidavit to show that the property is classified as Gramakantam. There is no material to show that a request was made, but the same was refused even though an assertion was made in the affidavit.
3. Having regard to the same, the Writ Petition is disposed of granting liberty to the petitioner to submit an application in writing by requesting to inform the petitioner the classification of the property as per the revenue records as communicated to the registering authority and also the stamp duty and the market value payable on the said property. As and when such a request is made, the Sub-Registrar, Bobbili, Vizianagaram District (2nd respondent) shall consider and pass orders and communicate the decision to the petitioner within a period of two (2) weeks from the date of receipt of such request. If the petitioner is aggrieved by any decision, it is open to him to work out his remedies. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
