Order:
This Writ Petition is filed for the following substantive relief:
“to issue an appropriate writ or order or direction, more particularly, one in the nature of Writ of Mandamus declaring the action of the Respondents in seizing the records such as stock register, sales register and original authorisation letter pertaining to the Petitioner's Fair Price Shop situated at Venkatapuram village, Saravakota Mandai, Srikakulam District pursuant to the surprise check / inspection conducted by the vigilance officials on 10.12.2014 as illegal, arbitrary, without following the procedure as contemplated under Essential Commodities Act,1955 and A.P. State Public Distribution System (Control) Orders, 2008, and also violative of principles of natural justice and consequently, direct the Respondents to return the records such as stock register, sales register and original authorisation letter to the Petitioner to enable her to run the said Fair Price Shop pursuant to the inspection conducted on 10.12.2014.”
At the hearing, the learned Assistant Government Pleader for Civil Supplies (AP) representing the respondents has admitted that an identical Writ Petition viz., W.P.No.38175 of 2014 was allowed by this Court by Order, dated 11-12- 2014. Regrettably, respondent Nos.3 and 4, who are parties to the said Writ Petition, have not learnt lessons from the said order and they are continuing their illegal action qua the petitioner.
For the same reasons as mentioned in WP.No.38175 of 2014, this Writ Petition is allowed with a warning to respondent Nos.3 and 4 not to repeat such conduct in future, failing which this Court will take a serious view.
As a sequel to disposal of the Writ Petition, WPMP.No.49638 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
