Counsel for respondent Nos.1 to 5: AGP for Revenue The Court made the following:
ORDER:
This writ petition is filed with the allegation that pending proceedings initiated for cancellation of DKT pattas granted in favour of the petitioners before respondent No.3, respondent No.5 has been unduly interfering with the petitioners’ possession of the assigned lands.
At the hearing, there is no representation for the petitioners.
The learned Assistant Government Pleader for Revenue (Assignment), on instructions, submitted that the assignments granted to the petitioners were cancelled by respondent No.3 by order, dated 26.12.2013.
The learned counsel for the petitioners is not present to controvert this submission.
In view of the same, the cause in the writ petition does not survive for adjudication. The writ petition is accordingly dismissed as infructuous with liberty to the petitioners to avail appropriate remedy, if they feel aggrieved by the order of respondent No.3 cancelling their assignments.
As a sequel to dismissal of the writ petition, W.P.M.P.No.45523 of 2013 shall stand disposed of as infructuous.
