HON’BLE Dr. JUSTICE K.G.SHANKAR Criminal Petition No.6895 of 2014 Order:
The petitioner is accused No.3 in C.C.No.231 of 2013 on the file of the I Additional Judicial Magistrate of First Class, Warangal. She allegedly committed offences under Sections 498-A and 506 IPC as well as under Sections 3 and 4 of the Dowry Prohibition Act, 1961. She sought for the quashment of the case on the ground that the allegations against her do not attract any of the offences.
2. Where the offences alleged are triable by a Judicial Magistrate of First Class in warrant procedure, I consider it appropriate for the petitioner to approach the Trial Court through a petition for discharge.
3. Consequently, this criminal petition is disposed of granting liberty to the petitioner-accused No.3 to move the Trial Court for discharge. The petitioner is exempt from attending before the Trial Court for a period of 4 (four) weeks to enable her to move the Trial Court for appropriate relief. The miscellaneous petitions, if any, pending in this petition shall stand closed.
