The grievance in the writ petition is about alleged dispossession of petitioner from an extent of Acs.0.25 cents of land, which is situated adjoining the land of petitioner in Valamarru Gram Panchayat, Palakol Mandal, West Godavari District. The petitioner claims to have grown about 70 coconut trees in the adjoining tank bund passing through the said survey number and is in possession and enjoyment of the crop from coconut garden. The possession of petitioner is admitted by Secretary, Valamarru Gram Panchayat.
From the material available on record, it is clear that there are few issues of fact, which this Court cannot conveniently adjudicate upon and exercise the discretion for grant of any relief to the petitioner.
Learned counsel appearing for the petitioner requests the Court to permit the petitioner to file comprehensive representation to the District Collector, West Godavari District and also to the Valamarru Gram Panchayat and Irrigation Department to have appropriate orders for lawful enjoyment of the tank bund. The petitioner is given four weeks time from today to file a representation to the authorities referred to above. The authorities shall consider the factual and physical possession and pass appropriate orders.
Status quo as on today shall be maintained till appropriate orders are passed by the authorities on the representation filed by the petitioner. It is made clear that if, no representation is filed within the time granted by this Court, the benefit of status quo order is not extended to the petitioner.
The writ petition is, accordingly, disposed of. No order as to costs. Consequently, miscellaneous petitions, if any, pending in the Writ Petition shall stand closed.
