HON’BLE SRI JUSTICE SANJAY KUMAR Writ Petition No.24484 of 2014 Date: 26.08.2014 Between:
Kondayyapalepu Ramakoti … Petitioner And The A.P. State Road Transport Corporation, rep. by its Vice-Chairman & Managing Director, Hyderabad & another … Respondents * * * HON’BLE SRI JUSTICE SANJAY KUMAR Writ Petition No.24484 of 2014 ORDER:
The petitioner seeks to assail the suspension order dated 01.08.2014 passed by the Andhra Pradesh State Road Transport Corporation (APSRTC). The only ground worthy of mention urged in the affidavit filed in support of the petition is that the petitioner is on the verge of the retirement and that placing him under suspension at this stage would cause him irreparable injustice. It is however admitted by Sri S.A.Razack, learned counsel, that the APSRTC has jurisdiction to place an employee under suspension pending enquiry and that there is no violation of the statutory regulations in this regard.
2. In that view of the matter, this Court is not inclined to interfere at this stage. However, as the petitioner is on the verge of retirement from service, it would be appropriate for the APSRTC to conclude the disciplinary proceedings instituted against the petitioner without undue delay.
3. The writ petition is accordingly disposed of with a direction to the APSRTC to complete the enquiry against the petitioner expeditiously and in any event, not later than three months from the date of receipt of a copy of this order. WP MP No.30666 of 2014 shall stand closed in the light of this final order. No order as to costs.
