THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL APPEAL No.738 of 2008 JUDGMENT:
The Criminal Appeal is preferred by the owner of the Hero Honda motorcycle, which was confiscated in crime No.3 of 2006 while convicting the accused in NDPS SC No.6 of 2006, for release of the vehicle.
Learned counsel for the appellant submits that the appellant is the owner of the motorcycle and he lent his vehicle to his friend, who committed the offence, and that the appellant has not committed any offence, and as such, the motorcycle may be released.
In view of the submission of the learned counsel for the appellant, this Court orders that the motorcycle confiscated in crime No.3 of 2006 on the file of Donkarayi P.S., shall be released to the appellant on his production of the documents to establish that he is the owner of the motorcycle.
The Criminal Appeal is accordingly partly allowed. Consequently, the miscellaneous petitions, if any pending in this appeal, shall stand closed.
