The petitioner allegedly committed an offence under the provisions of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities), Act, 1989 apart from committing the offences under the provisions of the Indian Penal Code.
A First Information Report was registered against the petitioner in Cr.No.86 of 2014 on the file of Dharmapuri P.S., Karimnagar District. The learned counsel for the petitioner submitted that a false complaint was lodged against the petitioner by the 3rd respondent owing to political reasons. I am afraid that the question whether the complaint is false or otherwise can be considered at the time of trial. This petition is, therefore, liable to be dismissed.
In view of the contention of the learned counsel for the petitioner that the complaint is politically motivated and in view of the proximity of the date of complaint and the date of election, it would be appropriate to direct the police not to arrest the petitioner till the completion of the investigation.
Accordingly, the Criminal Petition is dismissed. Consequently, miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
The concerned police are directed not to arrest the accused till the completion of the investigation.
