HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.18743 of 2014 ORDER:
Sri Kommoju Venkata Satyanarayana was an ex-serviceman. He was assigned Ac. 5.00 of land as an ex-serviceman, wherein he was issued ‘D’ Form Patta bearing DR No.142/88/B3, dated 13.04.1978. After his demise, the petitioners are in occupation of the above land. The petitioners intend to dispose of the said property. On 10.02.2014, wife of the ex-serviceman applied to the District Collector, Visakhapatnam (3rd respondent) for grant of No Objection Certificate to sell the property. Since no orders are passed on the representation submitted, this writ petition is instituted.
2. As per the orders in G.O.Ms.No.307, Revenue (Assignments.I) Department, dated 06.06.2013, the District Collector, Visakhapatnam (3rd respondent) has to grant No Objection Certificate to the lands assigned to ex- servicemen.
3. Since the representation submitted on 10.02.2014 by the petitioners is yet to be disposed of, this Writ Petition is disposed of directing the District Collector, Visakhapatnam (3rd respondent) to consider the request of the petitioners for grant of No Objection Certificate and pass appropriate orders, as warranted by law, within a period of three (3) weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
