Heard learned counsel for the petitioner.
Challenge in the writ petition is to an order passed in a first appeal arising out of a suit under Section 116 of the U.P. Revenue Code, 2006 for partition.
Against the order impugned, the petitioner has a statutory alternative remedy of a second appeal as provided under Section 208 of the U.P. Revenue Code, 2006, which statutory alternative remedy has not been availed.
The writ petition is accordingly dismissed on the ground of availability of a statutory alternative remedy, which remedy the petitioner may invoke, in case, so advised.
