1. The applicant has taken out present Misc. Civil Application seeking below mentioned directions:
"A. The Hon'ble Court would be pleased to allow the present application by restoring the Company Application No.12 of 2012 dismissed for non removal of office objections and thereafter permit the applicant to withdraw the Company Application No.12 of 2012 with a liberty to file afresh Company Application under the provisions of the Companies Act, 1956.
B. The Hon'ble Court would be pleased to dispense with the verification of the application in the overall interest of the justice."
2. The request to dispense with the affidavit is granted.
3. So far as the relief prayed for in para 7(A) is concerned, the applicant has requested, inter alia, that the order dated 16.01.2012 may be recalled and modified and the proceedings of original application i.e. Company Application No.12 of 2012 may be restored.
4. Having regard to the submissions made and details mentioned in the application, the request to the aforesaid extent is granted i.e. the order dated 16.01.2012 is recalled on a condition that the office objections shall be removed within 10 days from today. If the office objections are not removed within the above specified time limit then the said Company Application No.12 of 2012 shall stand automatically dismissed for non-prosecution and on this condition the proceedings of Company Application No.12 of 2012 are restored. The other relief prayed for in para 7(A) can be and will be considered after the said application is placed for hearing and appropriate order by the Registry.
5. With the aforesaid clarification, present M.C.A. is disposed of.
