This instant petition has been filed for expeditious disposal of application u/s 133 CrPC bearing Case No. 22/2018 (Komal Vs. Chitharu and others) pending before the respondent no. 2 Sub- Divisional Magistrate, Budhanpur, Azamgarh.
Heard learned counsel for the petitioner and learned AGA for the State.
It is submitted by the learned counsel that the respondent nos. 4 and 5 had encroached the public path constructed from Government fund. An application filed for removal of such obstruction is pending since 8.6.2018 and no effective order has been made till today, despite the report submitted by the concerned police station dated 25.6.2018 regarding such obstruction made by O.P. no. 4 and 5.
In view of the facts and circumstances of this case as well as submission made by the learned counsel for the applicant, respondent no. 2 Sub-Divisional Magistrate, Budhanpur, Azamgarh is directed to conclude the proceeding of application u/s 133 CrPC Case No. 22/2018 (Komal Vs. Chitharu and ors.) pending before him as expeditiously as possible preferably within three months from the date of production of certified copy of this order.
Accordingly, this petition stands disposed of.
