Heard learned counsel for the petitioner; learned A.G.A. for the respondents 1 and 2; and perused the record.
The instant petition seeks quashing of the first information report dated 9.3.2019 registered as Case Crime No.34 of 2019, under Sections 323, 354, 504 and 506 I.P.C., P.S. Eka, District Firozabad.
The allegations in the impugned first information report discloses commission of cognizable offence as regards outraging the modesty of the victim as also assaulting and threatening her. The petitioner is named by the victim in the first information report along with one unknown person.
As allegation disclose commission of cognizable offence the prayer of the petitioner to quash the first information report cannot be accepted.
The petition is dismissed with liberty to the petitioner to apply for bail.
