Heard learned counsel for the petitioner; the learned Standing Counsel for the State respondents 1 and 2; and Smt. Sudha Pandey for the respondent-bank.
The present petition has been filed for a direction upon the respondent bank to extend the benefit of Debt Waiver and Debt Relief Scheme of the State Government to the extent of Rs.1,00,000/-.
As to whether the petitioner is entitled to the benefit of Loan Waiver Scheme or not, if so, to what extent, can be examined by the Collector of the district concerned after giving opportunity of hearing to the respondent-bank.
In view of the above, this petition is disposed of by giving liberty to the petitioner to ventilate his grievance before the second respondent (Collector, Bulandshahar). If any such representation/application is filed along with certified copy of this order annexing relevant documents, within two weeks from today, the second respondent shall call for report from the respondent no.3 and, thereafter, shall proceed to decide whether the petitioner is eligible for such benefit of the Scheme or not and, if it is found that the petitioner is eligible for the benefit under the Scheme, appropriate order shall be passed, preferably, within next four weeks, so that the petitioner is in a position to comply with the same.
With the aforesaid liberty/observation/direction, the petition stands disposed of.
