Heard Sri Tanmay Varma holding brief of Sri Ayank Mishra, learned counsel for the applicant and learned A.G.A for the State.
This application under Section 482 Cr.P.C. has been filed seeking a direction to the learned Court below to decide the Complaint Case No. 2745 of 2009, (State Vs. Arun Kumar Singh and others), arising out of Case Crime No. 940 of 2009, under Sections 419, 420, 467, 468, 471, 506/34 IPC, Police Station Kotwali Orai, District Jalaun, pending in the Court of Chief Judicial Magistrate, Jalaun at Orai.
Learned counsel for the applicant submits that while the stay order has been vacated in the year 2015, the disputed trial has still remained pending.
Considering the fact that the trial has remained pending for very long and without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to decide the aforesaid case in accordance with law, without granting any unnecessary or long adjournments as expeditiously as possible, preferably within a period of one year from the date of production of a certified copy of this order, if there is no other legal impediment.
