Respondent Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to direct the Station House Officer, Samalkot Police Station, East Godavari District, to release the petitioners on bail in the event of their arrest in connection with Crime No.43 of 2014 of Samalkot Police Station, East Godavari District, in the interest of Justice..
The petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri T.Pradyumna Kumar Reddy, Advocate for the Petitioners and of the Public Prosecutor, for the Respondent, the Court made the following.
ORDER:
“Learned counsel for the petitioners withdrew the case so far as the second petitioner is concerned. Hence, this petition is dismissed as withdrawn so far as the second petitioner is concerned.
Petitioners 1 and 3 who are A2 and A4 allegedly committed matrimonial offences. Both the petitioners are women. The third petitioner is a student of BDS at Vijayawada.
In view of the sex of the petitioners and the nature of the offences alleged against them, I consider it appropriate to enlarge the petitioners on anticipatory bail.
Consequently, this Petition is allowed so far as petitioners 1 and 3 are concerned. The petitioners 1 and 3/A2 and A4 shall surrender before the learned IV Additional Judicial Magistrate of First Class, Kakinada, within two weeks from today. On such surrender, the learned IV Additional Judicial Magistrate of First Class, Kakinada, shall enlarge the petitioners on bail on a bond of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties each in a like sum to his satisfaction.
