This revision is preferred against orders dated 2-1- 2004 in I.A.No.2880 of 2003 in O.S.No.61 of 2001 on the file of District Judge, Visakhapatnam.
Heard advocate for petitioners.
As seen from the record, this impugned order is a common order in as many as seven I.As. This Court in C.M.A.No.144 of 2004 which is preferred against the order in I.A.No.4066 of 2001 in O.S.No.61 of 2001, dismissed appeal directing the court below to dispose of the suit itself within six months from the date of receipt of a copy of the order if it is not disposed of by that date. That order is dated 21-3-2005. Now the present revision is against the dismissal of petition filed to punish the respondents for violation of interim order and the trial judge observed that revision petitioner failed to make out prima facie material for the alleged violation and dismissed the application giving liberty to the petitioners to file fresh application if any violation is committed in future.
I do not find any illegality or incorrect findings in the order of the trial court and it rightly observed that the petitioners can file fresh application as and when there was fresh cause of action and fresh violation. Even now petitioners can avail that remedy.
For the above reasons, this Civil Revision Petition is dismissed confirming the findings of the lower court, with above observation.
As a sequel to the disposal of this revision, the Miscellaneous Petitions, if any, pending, shall stand dismissed.
