Order:
This Writ Petition is filed with the grievance that respondent No.3 has not been releasing the properties admeasuring Acs.2-82 cents in Rs.Nos.4/2B, 5/2, 6/1, 6/6B and 41/2 of Podalada Village, Razole Mandal, East Godavari District, though the restraint order and the conditional attachment order passed by respondent No.2 in respect thereof were set aside by the Andhra Pradesh Co-operative Tribunal at Visakhapatnam, vide Order, dated 22-02-2006, in OA.No.176 of 2004.
A perusal of the record shows that on 23- 06-2010, the petitioner has made a representation to the Divisional Co-operative Officer, Amalapuram, seeking release of the above- mentioned properties as the conditional attachment order in respect thereof was set aside by the Andhra Pradesh Co-operative Tribunal, Visakhapatnam. The record further reveals that by proceeding in Rc.No.1742/2010 B, dated 23.06.2010, the Divisional Co-operative Officer has asked respondent No.3 to furnish information as to whether the order passed by the Andhra Pradesh Co-operative Tribunal, Visakhapatnam, was questioned in the High Court and if so, the stage of the legal proceeding.
The grievance of the petitioner is that though more than four years had elapsed, the Divisional Co-operative Officer, Amalapuram, has not passed any order for release of her properties from attachment.
In my opinion, the petitioner is not diligent in pursuing her cause. Having made a representation nearly 4½ years ago, the petitioner has slept over the issue and suddenly approached this Court without renewing her request for release of the attached properties. In this view of the matter, I am not prepared to entertain the Writ Petition at this stage. However, the petitioner is permitted to make a fresh representation to the authority concerned. Within two weeks of receipt of such representation from the petitioner, the authority concerned shall consider the same and communicate its response to the petitioner.
Subject to the above direction, the Writ Petition is disposed of.
As a sequel, WPMP.No.47253 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
