JUDGMENT / ORDER

1) Rule.
Mr.Rahul Dave, learned Assistant Government Pleader waives service of notice of Rule on behalf of the respondent.
2) By this application, the applicants, seven in number, seek permission to be joined as a legal representatives of the deceased-appellant, Koli Ravji Arjanbhai on the record of Civil Second Appeal No.76 of 1996 and also seek permission to prosecute the appeal in accordance with law.
3) Heard Ms.Khyati Hathi, learned advocate for the applicants, who has invited the attention of the court to the averments made in the application to submit that the sole appellant has expired on 20.10.2011 and that the present application for bringing the heirs and legal representatives of the deceased-appellant has been filed within the prescribed period of limitation.
4) This Court has also heard Mr.Rahul Dave, learned Assistant Government Pleader for the respondent.
5) From the averments made in the application, it is apparent that the sole appellant has expired on 20.10.2011 and this application has been filed within the prescribed period of limitation for bringing the heirs and legal representatives of the deceased-appellant on record. In the circumstances, the application is allowed. The applicants as described in the cause title of the application are permitted to be brought on record as heirs and legal representatives of the deceased-appellant, Koli Ravji Arjanbhai on the record of Civil Second Appeal No.76 of 1996. Rule is made absolute accordingly with no order as to cost.
