(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) The present application is filed by the convict through jail seeking temporary bail for a period of 45 days so as to undertake repairing of house.
The jail remarks are on record.
The convict is undergoing 10 years imprisonment for an offence under Sections 304 Part-II, 504, 323, 447 of IPC and 135 of B.P.Act in Sessions Case No.12 of 1996. He was convicted by judgment and order dated 19.12.2008.
As on 29.6.2012, he has undergone 3 years and 7 months.
He has enjoyed 1 temporary bail and 1 furlough leave and reported in time.
There is nothing adverse reported against the convict.
For the contents of the application, the application is allowed. The convict is ordered to be released on temporary bail for a period of 30 days from the date of his release on his executing a personal bond of Rs.5,000/- (Rupees Five Thousand Only) to the satisfaction of the Jail authorities.
The convict shall surrender himself to the Jail authorities on expiry of the above temporary bail period. The application is allowed.
