Learned counsel for the petitioners is permitted to implead State respondent as party respondent no.5 and serve copy of the writ petition to Shri Anurag Srivastava, learned Standing Counsel forthwith.
Heard learned counsel for the petitioner and Shri Anurag Srivastava, learned Standing Counsel. Shri R.C. Upadhyaya has accepted notice on behalf of Gaon Sabha.
In view of the order proposed to be passed, notices need not go to private respondents.
The petitioners are before this Court for a direction to Sub Divisional Magistrate, Ghosi, Mau to decide Case No.302/9-8- 12 (Ram Milan & Ors. v. Kolahal & Ors.) under the provisions of Section 176 UPZA & LR Act within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of finally with a direction to the Sub Divisional Magistrate, Ghosi, Mau to consider and decide the aforesaid case in accordance with law expeditiously and preferably within a period of one year from the date of production of certified copy of this order but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, except upon payment of cost of Rs.200/-.
