Common Order:
These two Civil Revision Petitions arise out of two separate Orders, dated 04-03-2014, passed in IA.Nos.53 and 54 of 2014 filed in the same suit viz., OS.No.64 of 2008. Therefore, they are heard and disposed of together.
The petitioners filed the aforesaid suit on the file of the Court of the learned Principal Junior Civil Judge, Ongole, for recovery of possession of the suit schedule property from respondent Nos.1 and 2. The evidence of PW.1 was closed in the year 2011. Three years later, the petitioners have filed IA.No.53 of 2014 for reopening the evidence and IA.No.54 of 2014 for summoning the Official Receiver, Ongole, to produce the records in IP.No.52 of 1974 and IA.No.1611 of 1978. The lower Court dismissed both these applications on the reasoning that apart from the fact that the applications were filed three years after closure of the evidence of PW.1, the documents which are sought to be filed by the petitioners are public records, certified copies of which could have been obtained by them and filed. The lower Court further observed that these applications have been filed when the suit was coming up for the cross- examination of PW.1 and that therefore, the same are belated.
I have considered the reasons assigned by the lower Court in the impugned orders and I do not find any illegality or jurisdictional error therein.
The Civil Revision Petitions are, accordingly, dismissed.
As a sequel, CRPMP.No.1305 of 2014, filed for interim relief, is dismissed as infructuous.
