ORDER:
This petition is filed to withdraw divorce O.P.No.75 of 2014 from Family Court, Ongole and transfer the same to Family Court, Guntur.
Wife filed this petition contending that she is staying at Battibrolu of Guntur District and she is unemployee and she has no means to meet the expenses to travel from her village to Ongole and that Guntur is nearer to her village and it will be convenient for her for defending the subject OP filed by the husband at Guntur.
Respondent has not filed any counter. Advocate for respondent submitted that the respondent is an employee working in Bangalore and it will be difficult for him to attend for each and every adjournment; by dispensing with his presence the subject OP may be transferred.
Considering the submissions of both sides and also considering the convenience of the wife, O.P.No.75/2014 is withdrawn from the Family Court, Ongole and transferred to Family Court, Guntur for disposal in accordance with law. The Family Court, Guntur shall dispense with the presence of the husband for each and every adjournment. However, he shall appear as and when the Family Court, Guntur feels that his physical presence is necessary for any specific purpose.
The Transfer Civil Miscellaneous Petition is accordingly allowed. No order as to costs.
Pending miscellaneous applications, if any, shall stand closed in consequence.
