JUDGMENT / ORDER

This contempt case is filed seeking to summon the respondents and punish them for flouting the order dated 16.04.2012 passed in W.P. No.10699 of 2012 by this Court.
W.P. No.10699 of 2012 was filed seeking to declare the action of the respondents 1 and 2 in trying to allot the land of the petitioners in R.S. No.49 of Sanivarapupet village, Eluru Mandal, West Godavari district in favour of the 6th respondent for play ground and for construction of compound wall without any right, title and authority as bad, arbitrary, illegal and unconstitutional and consequently to direct the respondents not to interfere with peaceful possession and enjoyment of the petitioners in respect of the land admeasuring Ac.1.88 cents in R.S. No.49 of Sanivarapupet village, Eluru mandal, West Godavari district.
This Court on 16.04.2014 directed status quo as on that date shall continue.
Complaining that the order of status quo has been violated by the 2nd respondent by erecting two caution boards stating that the subject land belongs to Government and any encroacher of the said land will be punished.
On behalf of the respondents, counter affidavit has been filed stating that no such erection as alleged by the petitioners has been erected by the respondents. Therefore, the allegation made in the contempt case against the respondents is false.
The learned counsel for the petitioners would submit that after filing the contempt case, the petitioners came to know that some third parties have erected the said caution boards and not by the 2nd respondent.
Recording the same, the contempt case is closed. There shall be no order as to costs.
