Learned Chief Standing Counsel has accepted notice on behalf of opposite party no.1.
Let notices be issued to the opposite parties no.2 & 3 returnable at an early date. Apart from regular mode of service, the petitioner may serve notices on opposite parties no.2 &3 outside court. Office shall issue necessary documents.
Let a notice be issued to the learned Advocate General, U.P.
List and connect with writ petition no. 3183 (M/B) of 2009 and other connected petitions.
In the meantime, in case the petitioner deposits with the Nagar Nigam, Agra half of the amount demanded within a period of two months from today, further recovery proceedings with respect to tax in question shall remain stayed.In case, the petition succeeds, the amount deposited shall be returned by the Nagar Nigam to the petitioner.
Parties may exchange affidavits.
